Common Sense Reigns in British Court.

In a case that has been mentioned on this site before, a judge has ruled that some daft Muslim bint MUST remove her head bag during her trial for intimidating a witness, as reported by The Telegraph today:

Muslim woman Rebekah Dawson must remove niqab while giving evidence, judge rules

A Muslim woman has been given permission to wear a niqab during a criminal trial but must remove it while giving evidence, a judge has ruled.

Judge Peter Murphy made the ruling in the case of Muslim convert Rebekah Dawson, who is facing trial for allegedly intimidating a witness.

The 22-year-old had claimed her religious beliefs dictated that no male other than her husband could see her face.

Lawyers for the defendant had argued that forcing the 22-year-old convert to remove her niqab in court would be a breach of her rights under Article 9 of the European Convention of Human Rights.

But in a lengthy ruling, Judge Murphy said it was of "cardinal importance" to the adversarial system that a jury could see a defendant's face while giving evidence.

The issue first arose when Mrs Dawson refused to lift her veil in order to identify herself at a plea and case management hearing at Blackfriars Crown Court.

District Judge Murphy refused to let her enter the dock saying he could not be sure she was who she said she was.

The case was adjourned until last week when a compromise was reached and the judge allowed a female police officer to identify her in the privacy of a side room.

But Judge Murphy said he would have to consider how to proceed with the full trial and whether the defendant would be permitted to remain covered throughout.

During his ruling, the judge revealed that Mrs Dawson, who was referred to as D, had only worn the veil since May 2012.

But he said his decision would have been the same if she had worn it for years accepting that her feelings on the issue were sincere.

He went on: "I accept for the purposes of this judgment that D sincerely takes the view that as a Muslim woman, she is either not permitted or chooses not to uncover her face in the presence of men who are not members of her close family.

"I have been given no reason to doubt the sincerity of her belief."

Describing the anxiety that the issue was causing the judiciary, Judge Murphy said: "The niqab has become the elephant in the courtroom."

He said he hoped that "Parliament or a higher court will provide a definite answer" to the issue soon.

In her legal submissions, the defendant's barrister, Susan Meek, had argued that jurors would still be able to assess her demeanour by examining how her head, body and eyes moved.

She added: "There is always going to be a photograph of her, the jury will always be able to see her. The jury are more than able to know who they are trying by looking at a photograph of her."

But in a lengthy ruling handed down today Judge Murphy said the ability for a jury to see a defendant's demeanour during cross-examination was a principle part of the adversarial trial system.

He said while the defendant would have to remove her niqab while giving evidence, screens could be erected or video links used to ensure she was only visible to the judge, the jury and counsel.

He also ruled that court artists would not be permitted to sketch the defendant when her veil was removed.

Judge Murphy said: "I conclude that some restriction of the right of a defendant to wear the niqab during proceedings against her in the Crown Court is necessary in a democratic society."

He went on: "Balancing the right of religious manifestation against the rights and freedoms of the public, the press and other interested parties such as the complainant in the proper administration of justice, the latter must prevail over D's right to manifest her religion or belief during the proceedings against her to the extent necessary in the interests of justice.

"No tradition or practice, whether religious or otherwise, can claim to occupy such a privileged position that the rule of law, open justice and the adversarial trial process are sacrificed to accommodate it.

"That is not a discrimination against religion, it is a matter of upholding the rule of law in a democratic society."

Solicitors for Mrs Dawson have said they are considering their position but it is possible they could ask for a judicial review of the ruling.

Now that we know this daft cow's name we can see that see she wasn't born a Muslim, she's a convert. You would almost understand it had she been raised to think that she must never show her face to men & that it felt unnatural to her but this silly bint grew up a non-Muslim, she showed her face all the time before she converted. This proves that she was just making all this fuss to cause a bit of trouble, to say look-at-me-look-at-me-look-at-me! Aren't I pious? The judge may see no reason to doubt the sincerity of her beliefs but I do.

Muslims are taught that they are superior to the rest of us by their scripture, to wit:

You are the best of the nations raised up for men; you enjoin what is right & forbid the wrong & believe in Allah; & if the followers of the Book had believed it would have been better for them; of them (some) are believers & most of them are transgressors. Koran 3:110

O you who believe! Do not take the Jews & the Christians for friends; they are friends of each other; & whoever amongst you takes them for a friend, then surely he is one of them; surely Allah does not guide the unjust people. Koran 5:51

Surely the vilest of animals in Allah's sight are those who disbelieve, then they would not believe. Koran 8:55

And the Jews say: Ezra is the son of Allah; & the Christians say: The Messiah is the son of Allah; these are the words of their mouths; they imitate the saying of those who disbelieved before; may Allah destroy them; how they are turned away! Koran 9:30

What! He who is obedient during hours of the night, prostrating himself & standing, takes care of the hereafter & hopes for the mercy of his Lord! Say: Are those who know & those who do not know alike? Only the men of understanding are mindful. Koran 39:9

O you who believe! Do not take My enemy & your enemy for friends: would you offer them love while they deny what has come to you of the truth, driving out the Messenger & yourselves because you believe in Allah, your Lord? If you go forth struggling hard in My path & seeking My pleasure, would you manifest love to them? And I know what you conceal & what you manifest; & whoever of you does this, he indeed has gone astray from the straight path. Koran 60:1

Surely those who disbelieve from among the followers of the Book & the polytheists shall be in the fire of hell, abiding therein; they are the worst of men. Koran 98:6

As has been said before, these dumb women dress up like this as an outward expression of how much better than the rest of us they think they are. When they find out that they are not, they're going to come down with a bump.
